These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and BetaFocus ("we," "us," or "our") regarding your use of the Heal mobile application ("App," "Service," or "Application").

By accessing or using Heal, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

2.1 Age Requirements

You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use the Heal app. If you are under 18, you should have your parent or guardian review these Terms with you.

2.2 Account Responsibility

When you create an account with Heal, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized access or security breaches
• Accept responsibility for all activities that occur under your account

Heal is a wellness and emotional support application designed to help users navigate the healing process following heartbreak or relationship challenges. The Service includes:

• AI-powered conversational support and guidance
• Journaling tools and mood tracking features
• Personalized recommendations and content
• Premium features available through subscription

By using Heal, you agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any applicable laws, regulations, or third-party rights
• Attempt to gain unauthorized access to the Service or its related systems
• Reverse engineer, decompile, or disassemble any part of the Application
• Use automated systems (bots, scripts) to access the Service
• Interfere with or disrupt the Service or servers
• Transmit viruses, malware, or any harmful code
• Harass, abuse, or harm other users or our staff
• Impersonate any person or entity
• Collect or harvest information from other users

5.1 Free and Premium Features

Heal offers both free and premium subscription tiers. Premium subscriptions provide access to enhanced features and increased usage limits.

5.2 Subscription Terms

• Billing: Subscriptions are billed through your app store account (Google Play Store or Apple App Store)
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Cancellation: You can cancel your subscription at any time through your app store account settings
• Refunds: Refund requests are subject to the policies of your app store provider

5.3 Pricing Changes

We reserve the right to modify subscription prices with reasonable notice. Price changes will not affect current subscribers until their next renewal period.

6.1 Our Rights

All content, features, functionality, software, and materials provided through the Heal app, including but not limited to text, graphics, logos, designs, and software code, are owned by BetaFocus or our licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Heal app for personal, non-commercial purposes in accordance with these Terms.

6.3 Your Content

You retain ownership of any content you create within the app (journal entries, messages, etc.). By using the Service, you grant us a limited license to process, store, and display your content solely for the purpose of providing the Service to you.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• Your conversations, journal entries, and mood data are stored securely
• We use industry-standard security measures to protect your information

Heal utilizes artificial intelligence technology to provide conversational support and recommendations. You acknowledge and agree that:

• AI-generated responses are not professional medical, mental health, or therapeutic advice
• AI responses may occasionally be inaccurate, incomplete, or inappropriate
• You should not rely solely on AI-generated content for important decisions
• We do not guarantee the accuracy, completeness, or reliability of AI responses
• AI responses are based on patterns and data, not human judgment or expertise

9.1 "As Is" Service

The Heal app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties regarding accuracy, reliability, or availability of the Service
• Warranties that the Service will be uninterrupted, secure, or error-free

9.2 Limitation of Liability

To the maximum extent permitted by law, BetaFocus and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Damages resulting from unauthorized access to your account or data
• Damages resulting from any conduct or content of third parties

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

9.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless BetaFocus, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, including:

• Adding or removing features
• Changing usage limits or restrictions
• Modifying subscription plans or pricing

11.2 Account Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if:

• You breach these Terms or our policies
• We are required to do so by law
• Your conduct is harmful to other users or our business
• You engage in fraudulent or illegal activities

11.3 Your Right to Terminate

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BetaFocus operates, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through:

1. Informal Negotiation: First, contact us at healletgo@proton.me to attempt to resolve the dispute informally
2. Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration (where permitted by law)

12.3 Class Action Waiver

Where permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

The Heal app may integrate with or contain links to third-party services, websites, or content. We are not responsible for:

• The availability, accuracy, or content of third-party services
• Any damages or losses caused by third-party services
• The privacy practices of third-party services

Your use of third-party services is subject to their own terms and conditions.

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or service offerings. We will notify you of material changes by:

• Posting the updated Terms in the app
• Updating the "Last Updated" date at the top of this page
• Sending you a notification through the app or email (for significant changes)

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

15.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15.2 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
